Terms of Use

These Terms of Use ("Terms") govern your use of the Filmkro website and its content (the "Site"), operated by Filmkro LLC, a U.S. media and film company ("Filmkro", "we", "us" or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

ReelTayo, our short-drama platform, has its own Terms of Service, which apply when you use the ReelTayo app, web app or website.

1. Using the Site

You may use the Site to learn about Filmkro, our work and our projects, and to contact us. You agree not to:

  • use the Site in a way that is unlawful, fraudulent or harmful to others;
  • send spam, malicious code or automated submissions through our forms;
  • scrape, copy or harvest Site content or data by automated means;
  • interfere with, disrupt or try to gain unauthorized access to the Site or its systems; or
  • impersonate any person or misrepresent your connection with Filmkro or ReelTayo.

We may change, suspend or retire any part of the Site at any time.

2. Intellectual Property

The Site and its content, including text, images, posters, stills, videos, graphics, logos, design and software, and the names Filmkro and ReelTayo, are owned by Filmkro or its licensors and are protected by intellectual property laws. You may view the Site and share links to it for personal or internal business purposes. Any other copying, reproduction, distribution, modification or public display requires our prior written permission. No rights are granted to you except as stated in these Terms.

3. Inquiries and Partnerships

Our inquiry forms let you start a conversation with us about content, brand, media, investment or strategic partnership opportunities. Sending an inquiry, and any discussions that follow, do not create a partnership, licence, investment or other agreement. Any agreement between you and Filmkro exists only when it is set out in a written contract signed by both parties.

Information on the Site about our services, projects and partnership models describes our work in general terms. It is not an offer to sell, or a solicitation to buy, any security or investment.

4. Ideas, Scripts and Other Submissions

We develop many stories and projects of our own, and some may resemble ideas we receive from others. For that reason, unless we have agreed otherwise in a written agreement signed by both parties:

  • please do not send scripts, treatments, formats or other creative material through the Site; a short description of your project is enough to start a conversation;
  • anything you send us through the Site is not treated as confidential; and
  • sending us an idea or material does not create any obligation for Filmkro to review it, keep it confidential, compensate you or credit you, and does not limit our right to develop similar projects created independently.

You confirm that you have the right to share anything you send us. Feedback and suggestions about the Site or our work may be used freely, without obligation to you.

If you believe content on the Site infringes your copyright or other rights, please contact us with a description of the work, where it appears on the Site and your contact details, and we will review it promptly.

5. Links to ReelTayo and Other Sites

The Site links to ReelTayo and may link to other websites and services. When you use ReelTayo, the ReelTayo Terms of Service and Privacy Policy apply. Other websites and services are governed by their own terms, and Filmkro is not responsible for their content or practices.

6. Site Provided "As Is"

We work to keep the Site accurate and available, but it is provided "as is" and "as available". To the fullest extent permitted by law, Filmkro makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Filmkro and its affiliates, officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, goodwill or profits, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, or any rights you have as a consumer under the mandatory laws of your country.

8. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Filmkro and its affiliates from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the Site, material you send us or your breach of these Terms.

9. Governing Law and Disputes

These Terms are governed by the laws of the United States and of the U.S. state in which Filmkro LLC is organized, without regard to conflict-of-law rules. Before starting any formal proceeding, please contact us so we can try to resolve the matter informally. Any dispute that is not resolved informally will be brought in the courts located in that state, unless the mandatory laws of your country give you the right to bring proceedings where you live.

10. Changes to These Terms

We may update these Terms from time to time. Updated Terms take effect when we post them on this page with a revised date. If you continue to use the Site after that, you accept the updated Terms.

11. General

These Terms and our Privacy Policy are the entire agreement between you and Filmkro about the Site; a separate signed agreement governs any business relationship. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. If these Terms are translated, the English version prevails to the extent permitted by law.
